California Repeals Marriage Law

California Proposition 3 passed, and repealed the definition of marriage as between a man and a woman.

It does not explicitly authorize same-sex marriage, but leaves that to the courts.

That may seem odd, but it is consistent with the anti-democracy positions of today Democrat Party. VP Kamala Harris hardly took any political positions in the recent campaign. One thing she was clear on, was that she very much preferred the US Supreme Court dictated abortion law, as long as she agreed with the opinion. She sharply criticism the decision that allowed the states to pass their own abortion laws.

So who is eligible to marry in California? Underage couples, incest, polygamy, animals, robots, etc. No one knows. It is up to future courts to decide.

Part of the purpose of marriage is to have some institutional authority for the process. That has eroded. When the same-sex marriage cases went to the US Supreme Court, it refused to rule on the California marriage law, and instead ruled on certain other privileges, such as filing a federal joint tax return and getting a federal estate tax exemption. It was concerned with federal monetary side-issues, not the marriage itself.

The major religions, Roman Catholicism, Islam, Orthodox Judaism, etc. do not accept same-sex marriage.

Marriage should at least mean joint custody of the resulting kids, but that is not true anymore. As I posted yesterday, a dad lost all rights over his sons, over his objection to transgenderizing one of them.
